These terms regulate the use of the enigmasac.com website and the contracting of services offered by Enigma Developers S.A.C., including web development, server and cloud administration, corporate email, cybersecurity, automation, artificial intelligence agents, and technology consulting.
3. Acceptance
Access to and use of this website, as well as the contracting of any of our services, implies full acceptance of these terms and conditions. If you disagree with any of them, we recommend not using this site or contracting our services.
4. Services
Enigma Developers S.A.C. offers technology services that can be contracted individually or through monthly subscription plans. Services include, among others:
- Design and development of websites and applications
- Server and cloud infrastructure administration
- Corporate email implementation and management (Google Workspace)
- Cybersecurity audits and protection
- Process automation and API integration
- Development of custom artificial intelligence agents
- Comprehensive technology consulting
The specific scope of each service is detailed in the corresponding commercial proposal or service agreement.
5. Prices and payments
- The prices of our services are customized according to each client's needs and are clearly communicated in the commercial proposal.
- Subscription plans are billed monthly. Payment must be made within the first 5 days of the billing cycle.
- We accept bank transfers, card payments, and other methods depending on the client's location.
- Prices do not include taxes, unless expressly indicated.
6. Duration and cancellation
- Subscription plans are monthly and can be canceled at any time without penalty.
- Cancellation must be communicated at least 10 days before the next billing cycle.
- Individually contracted services are governed by the deadlines established in the corresponding agreement.
- In case of cancellation, the client maintains access to their website, data, servers, email, and any development performed.
7. Intellectual property
Intellectual property is governed by the following rules:
- Source code, designs, and developments made for the client are the property of the client once the corresponding payment is completed.
- The brand, logo, design, and content of the enigmasac.com website are the exclusive property of Enigma Developers S.A.C.
- Reusable tools, frameworks, and components developed generically by Enigma Developers S.A.C. may be used in other projects.
8. Client obligations
The client commits to:
- Provide truthful and up-to-date information
- Provide the access and credentials necessary for service delivery
- Make payments within the agreed deadlines
- Not use contracted services for illegal activities
- Respect the intellectual property of third parties
9. Limitation of liability
- Enigma Developers S.A.C. is not responsible for service interruptions caused by third parties, force majeure, or circumstances beyond its control.
- The maximum liability of Enigma Developers S.A.C. is limited to the total amount paid by the client in the last 3 months for the affected services.
- We are not responsible for content published by the client on their website or platforms.
10. Confidentiality
Both parties commit to maintaining the confidentiality of sensitive information shared during the commercial relationship. This obligation remains in effect even after the termination of services.
11. Modifications
Enigma Developers S.A.C. reserves the right to modify these terms at any time. Modifications will be published on this page and, in case of significant changes, active clients will be notified by email.
12. Applicable law
These terms are governed by the laws of the Republic of Peru. For clients located in the European Union, the consumer protection provisions of the client's country of residence will additionally apply. Any dispute will be resolved before the competent courts of Lima, Peru, unless otherwise agreed between the parties.
